Domain Name Violation

In 2011 Ilieva Voutcheva & Co Law Firm started to consult one of the founding companies dealing with publishing of tourist guide books in English for some of Bulgaria major cities as well as providing an web-site data base about all renowned hotels, airlines, rent-a-car companies, bars and restaurants, diplomatic missions and business. We consulted the company on the case of domain violation by a competitor web-site. The domain used by the competitor was protected by a trade mark registered by our client. Moreover the website of our client and the website of his competitor are both concerning the same subject and there was a violation of copyrights as well. Not only had we consulted on the violation of the Protection of Competition Act but also violations of provisions of the Consumer Protection Act and the Marks and Geographical Indications Act. The basic issue consulted with the Law Firm was undertaking measures against the company that uses the domain in violation with the registered trade mark. Ilieva Voutcheva & Co Law Firm provided and discussed with the client the ways to resolve the case without going to court in the fastest possible way. Ilieva, Voutcheva & Co drafted invitation to the competitor to voluntary stop using this domain or change it to another one. This case was closed on the 1st of September 2011 after the successful negotiation and the removal of the competitor’s domain from the web.
