The case involved a claimed by the Commission for Protection of Competition (“CPC”) violation of the breach for unfair competition. The client has organised a promotion of one of his products that in particular may be considered violating to the provision of the Protection of Competition Act (“PCA”). The promotion was said to be a misleading advertising. However since the client has involved efforts and considered the prohibitions above it was not clear if there is an actual violation. The Law Firm has provided an extensive legal opinion supported by evidences with respect to the fact that the law was not breached.

The penalties under the PCA are calculated as a percentage over the annual turnover of the respective legal entity. The turnover of the client for the 2009 is at the amount of over EUR 110,000,000.
